Terms & Conditions for Membership & Electric Service

Qualifications and Obligations for Membership. Any person or entity shall become a member of Mille Lacs Energy Cooperative by taking delivery of electric energy from the Cooperative. No person or entity may have more than 1 membership in the Cooperative.

Member Contract. The members of the Cooperative, by dealing with the Cooperative, acknowledge that the terms and provisions of the Articles of Incorporation and Bylaws shall constitute and be a contract between the Cooperative and each member, and the Cooperative and the members are bound by such contract as fully as though each member had individually signed a separate instrument containing such terms and provisions. The provisions of this Article of the Bylaws shall be called to the attention of each member of the Cooperative by posting in a conspicuous place in the Cooperative’s office.

As a member, you agree to comply with all existing easements on said property from Mille Lacs Energy or its predecessor organizations.You recognize that where the Cooperative has existing facilities on said property that you grant Mille Lacs Energy permission for Right-of-Way maintenance, operational procedures, and access to Cooperative equipment. MLEC has the right of ingress to and egress from the Right-of-Way over the member’s adjacent lands lying between public or private roads.

With payment of first bill, you are agreeing to the following Terms & Conditions for Mille Lacs Energy Cooperative Membership & Electric Service

The member will, when electric energy becomes available, purchase and take delivery from the Cooperative all electric energy purchased for use on the premises and will pay therefore in accordance with the appropriate rate schedule as determined from time to time by the Cooperative; provided, however that the Cooperative may limit the amount of electric energy to be furnished for industrial use until proper contracts and system changes can be made to accommodate any Member’s special needs.
The member will cause his/her premises to be wired in accordance with wiring specifications as required by the StateBoard of Electricity and the Cooperative. It is the member’s responsibility to maintain their electric service in such a manner that the meter remains accessible to the Cooperative at all times. Should accessibility to the meter become restricted, the member shall be responsible for all expenses associated with relocating the metering.
The member will comply with and be bound by the provisions of the Articles of Incorporation and Bylaws of the Cooperative, and any rules, regulations and policies as may from time to time be adopted by the Board, and specifically acknowledges the authority of the Cooperative to inspect, repair, upgrade and maintain the electric distribution system, which includes keeping the right-of-way clear of all buildings, structures, trees, undergrowth and other obstructions that may interfere with or endanger the Cooperative’s facilities and equipment.
The member agrees to furnish at no cost to the Cooperative any reasonably requested easement over, above, across or under the surface of the land owned or leased by the member, not only for the purpose of extending service to the member, but also for the purpose of extending service to others or otherwise constructing needed facilities.
The member assumes no personal liability or responsibility for any debts or liabilities of the Cooperative, and it is expressly understood that under the law his private property is exempt from execution for any such debts or liabilities.
If the member becomes indebted to the Cooperative and Cooperative incurs costs in collection of the debt, the member agrees to be financially liable and responsible for all costs of collection in addition to the debt.
To avoid the expense of preparing checks when refunds of electric account credit balances are less than $25, the Cooperative will transfer the balance to another active account belonging to the member. If the member has no active account, balances less than $25 will be donated.
Continuity of Service: The Cooperative will use reasonable diligence to provide and maintain uninterrupted service to its members. In cases of cessation, deficiency, variation in voltage, or any other failure or reversal of the service resulting from acts of God, public enemies, vandalism, accidents, strikes, riots, wars, repairs, orders of court, or other acts reasonably beyond the control of the Cooperative, the Cooperative shall not be liable for damages, direct or consequential, resulting from such interruption or failure.
Once service is active and energized a monthly Access Fee of $49.00 will be applied.
